TERMS AND CONDITIONS

  • After a snowfall of 5cm or more, snow removal will be carried out in such a way as to best serve our clients in the professional judgement of the contractor, and to the best of our ability. The contractor must be permitted to remove snow from your property at any time of the day or night.

  • Snow removal means moving or blowing snow from the described physical area to any close by. No loading or snow transportation, sanding, salting, de-icing or hand shovelling is indicated in this contract unless otherwise specified.

  • The term of this contract is from November 1st to April 15th of the indicated season, or up to the total accumulation of 250cm of snow as recorded by the local Weather Bureau in Montreal, Qc. (The average annual snow for this area is approximately 250cm.) The customer agrees to pay such a surcharge for additional accumulations of snow proportionally to the agreed rate charged.

  • Additional services requested by the customer that cannot wait or be done during regular snow removal services may be done at an additional charge (eg: request for individual cleaning when a vehicle is moved upon return from vacation, or snow is piled from a roof or walkway).

  • Cheques returned for any reason will incur an administrative fee of $25.00 per cheque. If for any reason, the contractor must return or exchange any cheques, an administrative charge of $25.00 will be applied.

  • In default of any payment or upon the breach of any of the conditions herein on the part of the client, this contract shall be rendered null and void. LOYAL ENTERPRISES shall be release from all liability for services to that time and shall not be required to perform any further services under this agreement. Upon cancellation of the contract by the client, LOYAL ENTERPRISES shall not be responsible for refunding the first payment.

  • The customer understands that it is his or her responsibility to ensure that no articles are left and/or hanging in the designated snow removal area. The contractor shall not be held responsible for damage to these articles such as recycle boxes, extension cords, flower pots, garbage cans, etc.

  • The contractor shall not be held responsible for any damages caused to articles left in the snow removal area, nor property, moveable and immovable arising from the invisibility due to snow coverage, including, but not limited to water valves, asphalt in poor condition or gravel. The contractor shall not be responsible for any damages arising from scraping, scratching or rusting of the driveways.

  • For downward slopping laneways, the contractor shall not be responsible for damages caused to borders, retaining walls or garage doors caused by sliding snow removal equipment arising from icy conditions.

  • In the event that vehicles are parked in the driveway, snow will only be plowed for the accessible areas opening on to the street.

  • Walkway clearing service, if included in this contract, will begin at the end of each snowfall of 5cm or more. This service does not include removal of snow accumulation of ice from the walkway resulting from freezing rain, sleet or compaction.
